New York contractors say they will pay tax despite a court ruling that the tax is unconstitutional

The New York Building Congress says it will voluntarily pay a tax declared unconstitutional by the courts because, it says, the money is vital to maintaining the city’s transportation infrastructure.
“The least we can do is voluntarily pay the tax, and we’re encouraging others that were exempted to pay the tax as well,” says Richard Anderson, president of the NYBC. The Mobility Payroll Tax, which effectively takes 34 cents from every $100 of payroll from employers in the Metropolitan Transit Authority region, was initiated in May 2009.
